  1. About Us and the Ordering Facility and Registration Process in respect of ascertaining Certificates of Origins
    1. The Arab-Irish Chamber of Commerce is a registered business name of The Joint Arab-Irish Commerce Chamber CLG, hereinafter referred to as “AICC”, private company limited by guarantee holding company number 101455 (registered in the Republic of Ireland at 34 Fitzwilliam Place, Dublin 2, Ireland).
    2. The AICC, amongst other services, provides the services of certification, authentication, legalisation, notarisation and/or translation for customers with commercial, export, legal or regulatory-related matters that pertain to one of the 19 relevant countries. On foot of information provided by customers via submission of the relevant form through the ordering facility, the AICC, where appropriate, can generate a Certificate of Origin for export orders which may include attestation by the Department of Foreign Affairs and relevant Embassies if needed.
    3. The following are the terms and conditions for use of the ordering facility and registration process in respect of ascertaining Certificates of Origins, Notarisation, AICC Certification, Department of Foreign Affairs & Trade Authentication, Embassy Legalisation and Translation of Documents (as required) and other products and/or services that may be provided by the AICC as provided for on the AICC’s website, www.commercial.aicc.ie, hereinafter referred to as the “Products and/or Services”. We ask that you carefully read these terms before using our website generally and in particular before using the ordering facility and registration process in respect of ascertaining Certificates of Origins. These terms of use tell you about the way you can use our website for the aforementioned purposes and by continuing to browse and/or interact and/or register on our website, you accept these terms and conditions. We ask you to take particular note of the fact that all of the Products and/or Services provided and governed by these Terms and Conditions are bespoke and made and/or provided to order.
  2. About these terms and conditions of use
    1. Access to and use of the website and the ordering facility and registration process in respect of ascertaining Products and/or Services both within Ireland and internationally is provided by the AICC. These terms apply to your use of the website, and in particular your use of the ordering facility and registration process in respect of ascertaining the Products and/or Services, and shall take effect immediately from your first use of the website and thereafter. Please note, in order to use the website you must agree to be bound by all the terms provided (Please note, if you do not agree to be bound by all the terms herein, the AICC does not permit you to access, use and/or register to the website).
    2. The AICC reserves the right to change these terms from time to time and any changes to our legal terms and conditions will take effect immediately when they are placed on our website and will apply to all future use of our website. You should regularly check these terms and conditions and our policies posted on our website as they may have changed since your last visit. Your continued use of the website will be deemed acceptance of any updated or amended terms. If you do not agree to the changes, you should cease using the website. If there is any conflict between these terms and specific local terms appearing elsewhere on the website then the latter shall prevail in relation to the matter to which it specifically relates.
  3. Use of the website and ordering facility, registration rules and receipt of the Products and/or Services
    1. You agree to use the website, and in particular the ordering facility and registration process in respect of ascertaining the Products and/or Services, only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website.
    2. You agree that any information including but not limited to registration information that you provide to the AICC is true, accurate and complete, and you agree to keep it that way at all times.
    3. In respect of your use of the website and in particular the ordering facility and registration process in respect of ascertaining the Products and/or Services, the following is not permitted for any reason whatsoever; engaging in any activity, or registering and/or using a username, which is or includes material that:
      • is offensive, abusive, defamatory, pornographic, threatening, or obscene;
      • is illegal, or intended to promote or commit an illegal act of any kind, including but not limited to violations of intellectual property rights, privacy rights, or proprietary rights of the AICC or a third party;
      • includes your password or purposely includes any other user’s password or purposely includes personal data of third parties or is intended to solicit such personal data;
      • includes malicious content such as malware, Trojan horses, or viruses, or otherwise interferes with any user’s access to the service;
      • is intended to or does harass or bully other users;
      • is intended to or does result in the circumvention of the rules pertaining to ascertaining the Products and/or Services;
      • impersonates or misrepresents your affiliation with another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading;
      • interferes with or in any way disrupts the AICC website, tampers with, breaches, or attempts to probe, scan, or test for vulnerabilities in the service or AICC computer systems, network, usage rules, or any of the AICC’s security components, authentication measures or any other protection measures applicable to the service, the content or any part thereof; or
      • conflicts with any agreements whatsoever, as determined by the AICC.
    4. Your password protects your user account, and you are solely responsible for keeping your password confidential and secure. You understand that you are responsible for all use of your username and password on the service. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by third parties, please notify The AICC immediately and change your password as soon as possible.
    5. If you submit or share offensive or inappropriate content or otherwise engage in any disruptive behaviour on the website and in particular through your use of the ordering facility and registration process in respect of ascertaining the Products and/or Services, and the AICC considers such behaviour to be serious and/or repetitive, the AICC may use whatever information that is available to it about you to stop any further such infringements.
  4. Order Process
    1. All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.
    2. The AICC is not obligated under any circumstances to accept your order.
    3. Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
      • The Product and/or Service you ordered is permanently or temporarily unavailable;
      • Our inability to obtain authorisation for your payment;
      • We have identified a pricing or Product and/or Service description error;
      • There is a system or procurement failure; and
      • Failed customer validation checks.
    4. When you place an order on our website we will email you an acknowledgement detailing the product you have ordered. This email is not an order confirmation or order acceptance from AICC.
    5. Acceptance of your order and the completion of the contract between you and the AICC will take place when your order has been dispatched. We will email you when your order has been dispatched. We reserve the right to dispatch multiple orders separately and via different modes of dispatch.
  5. Price and Payment
    1. The price payable for the services shall be as shown on the Website. Prices advertised on the Website include IRISH VAT but excludes delivery charges where applicable. Delivery charges, where applicable, are shown separately when ordering and must also be paid in advance.
    2. Payment shall be made by you by the means specified on the website and shall not be deemed to be made until we have received cleared funds in respect of the full amount stated in the order.
    3. Prices are subject to change without notice but changes will not affect orders which we have already accepted.
    4. Our site contains a number of Products and/or Services and it is always possible that, despite our best efforts, some of the services and/or products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a service and/or product correct price is less than our stated price, we will charge the lower amount when processing your order. If a Product’s and/or Services's correct price is higher than the price stated on our site, We will normally, at our discretion, either contact you for instructions before processing your order, or reject your order and notify you of such rejection.
    5. We are under no obligation to provide the Product and/or Service to you at the incorrect (lower) price, even after we have sent you a dispatch confirmation, where applicable, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing.
    6. The manner in which payment may be made to the AICC by you as user and/or account holder for Products and/or Services is determined by the AICC, allocated at the sole discretion of the AICC and governed entirely by the AICC. Options for payment for all Products and/or Services include payment by debit/credit card at the time of ordering and/or by supplying a cheque or bank draft following the placement of an order. Users who have an account with the AICC may, in circumstances to be determined and agreed by the AICC, pay by agreed terms upon receipt of a monthly invoice.
    7. All prices advertised are subject to such changes.
  6. Intellectual Property
    1. All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the website and all content (including all application forms and processes) located on the website shall remain vested in the AICC or its licensors (which includes other users).
    2. You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use the website’s content in any way except for your own personal use in respect of ascertaining a Certificate of Origins or Certificates of Origins. You also agree not to adapt, alter or create a derivative work from any website content except for your own personal use. Any other use of the website’s content requires the prior written permission of AICC.
    3. The names, images and logos identifying the AICC third parties and their products and services are subject to copyright, design rights and trade marks of the AICC and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right to use any trade mark, design right or copyright of the AICC or any other third party.
  7. Data Protection

    The Use of Personal Data: As protecting privacy is very important to the AICC, anyone using AICC website or database facilities must also ensure that the privacy of others is protected throughout. Therefore, any personal information (Personal Data) about another accessed, downloaded or obtained via the AICC websites/databases will be handled in compliance with the Data Protection legislation and in particular the General Data Protection Regulation. Personal Data is any information by which a person can be identified e.g. name, address (including email address), telephone number etc.

  8. Disclaimers and limitation of liability
    1. The majority of content posted on the website, and in particular that pertaining to the ordering facility and registration process in respect of ascertaining Certificates of Origins, is created by employees of the AICC. The views expressed are theirs and unless specifically stated are not those of the AICC. The AICC is not responsible for any content posted by employees or members of the public on the website or for the availability or content of any third party sites that are accessible through the website. Any links to third party websites from the website do not amount to any endorsement of that site by the AICC and any use of that site by you is at your own risk.
    2. The content of the website, including the information, names, images, pictures, logos and icons regarding or relating to the AICC, its products and services (or to third party products and services), is provided ‘AS IS’ and on an ‘AS AVAILABLE’ basis. To the extent permitted by law, the AICC excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. The AICC does not guarantee the timeliness, completeness or performance of the website or any of the content. While we try to ensure that all content provided by the AICC is correct at the time of publication no responsibility is accepted by or on behalf of the AICC for any errors, omissions or inaccurate content on the websites.
    3. Reference herein to any specific commercial products, process, or service by trade name, trademark, manufacturer, or otherwise, does not necessarily constitute or imply its endorsement, recommendation, or favouring by AICC. The views and opinions of authors expressed herein do not necessarily state or reflect those of the AICC, and shall not be used for advertising or product endorsement purposes.
    4. You agree to indemnify the AICC and/or the officers, directors and employees of the AICC, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the website and in particular the ordering facility and registration facility.
    5. The AICC shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise):
      • loss of data;
      • loss of revenue or anticipated profits;
      • loss of business;
      • loss of opportunity;
      • loss of goodwill or injury to reputation;
      • losses suffered by third parties; or
      • any indirect, consequential, special or exemplary damages arising from the use of commercial.aicc.ie and in particular the ordering facility and registration process in respect of ascertaining Certificates of Origins regardless of the form of action.
    6. The AICC does not warrant that functions available on the website and/or ordering facility and registration process in respect of ascertaining Certificates of Origins will be uninterrupted or error free, that defects will be corrected, or that the websites or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
  9. General
    1. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.
    2. The AICC shall not be liable for any failure to perform any of its obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. The failure or delay of the AICC to exercise or enforce any right in these terms does not waive the AICC’s right to enforce that right unless acknowledged and agreed to by us in writing.
    3. These terms shall be governed by and interpreted in accordance with the laws of Ireland which shall have exclusive jurisdiction over any disputes.
    4. If you breach any of these terms and conditions the AICC, in its sole discretion, may prevent you from using this website and any services provided thereon on a permanent or temporary basis and/or terminate your account. The AICC can take other action as well including but not limited to reporting you to the police or other law enforcement body, issue a warning or take legal action against you and pursue any costs we incur as a result of doing this.
    5. The AICC may terminate the website and the services provided thereon with or without cause at any time and effective immediately.
    6. The section titles in these terms of use are solely used for the convenience of the parties and have no legal or contractual significance.
    7. For the sake of clarity the 19 relevant countries referred to in these Terms and Conditions to which the Products and/or Services pertain are:
      Algeria, Bahrain, Djibouti, Iraq, Jordan, Kuwait, Lebanon, Libya, Mauritania, Morocco, Qatar, Saudi Arabia, Somalia, Sudan, Syria, The Sultanate of Oman, Tunisia, United Arab Emirates, Yemen.
